Jonathan Baughman, Partner and Chris Halgren, Associate of McGinnis Lochridge were featured in an article in Texas Lawyer. The case, Graham v. Prochaska, was started in Karnes County, Texas, in 2012 and focused on a number of deed interpretation issues.  Baughman explained that the district court and the court of appeals confirmed that Prochaska reserved a floating one-half of royalty by interpreting the entire language of the deed to determine the intent of the parties. "We believe the court by its action confirmed that in interpreting a deed or instrument, a court should be guided by the intent of the parties as determined from the entirety of the language used by the parties to an instrument and not just based on certain words or phrases viewed in isolation or taken out of context," said Baughman.  To view the full article, please go to: http://www.texaslawyer.com/id=1202739841316/High-Court-Declines-Review-of-Dispute-Over-Oil-Deed-Interpretation#ixzz3oeCLfv1m.
