Overview
Austin is a commercial litigator in the firm's General Litigation practice group. He represents individuals, businesses, and governmental entities in state and federal courts in Texas. He frequently represents business clients in a wide range of lawsuits involving contract disputes, business torts, complex business divorces, real estate, and misappropriation of trade secrets. He also represents law firms and their attorneys when sued for legal malpractice and breach of fiduciary duty, as well as governmental entities in matters involving constitutional issues and election laws.
Austin has first-chair experience in both bench and jury trials representing multi-national corporations, local businesses, and individuals. He has significant first-chair experience obtaining emergency injunctive relief and temporary injunctions to protect his clients' business interests in high-stakes situations. Austin has also prepared numerous briefs in appeals pending before state and federal appellate courts, and has presented oral arguments to intermediate courts of appeal in Texas. From drafting critical motions to trial advocacy to appeals, Austin is comfortable in all phases of litigation.
A native Texan, Austin has called Austin home for the majority of his life. He earned his undergraduate degree from the University of Texas at Austin and graduated cum laude from Pepperdine University School of Law. Prior to law school, Austin worked for the non-profit Young Life in Dorado, Puerto Rico. Austin is married to Morgan and they have four beautiful children, Poppy, Millie, Shep, and Scottie.

State Court
- Obtained unanimous jury verdict in Travis County in favor of local business on breach of contract, fraud, and misrepresentation claims.
- Obtained defense judgment following bench trial in Travis County in favor of multi-national corporation on breach of contract, fraud, and misrepresentation claims.
- Obtained emergency dissolution of temporary restraining order and order for disbursement of bond in Hill County, Texas on behalf of agricultural lender wrongfully restrained from exercising its right to foreclose on security interest.
- Obtained summary judgment in McMullen County, Texas on behalf of a mineral interest owner in a title and royalty dispute with an oil and gas operator that led to settlement favorable to client.
- Obtained emergency injunctive relief and temporary injunction in Hays County, Texas for business owner in high-stakes nuisance case.
- Obtained emergency injunctive relief in Caldwell County, Texas to protect clients' preserve clients easement rights in connection with real estate development.
- Obtained emergency injunctive relief in Travis County, Texas in favor of owners of historic farm against real estate developer engaged in construction on disputed lands.
- Obtained emergency injunctive relief in Harris County, Texas in favor of manufacturer against vendor wrongfully retaining clients' property.
- Successfully resolved mineral title dispute in Potter County, Texas between buyer and seller of mineral interests through online auction.
- Obtained reversal of trial court's denial of a plea to the jurisdiction and dismissal of claims on behalf of county in the Waco Court of Appeals. See Coryell Cnty. v. H&S Perryman Ranch, LLC, No. 10-23-00173-CV, 2014 Tex. App. LEXIS 70 (Tex. App.--Waco Jan. 4, 2024).
Federal Court
- Successfully resolved federal trademark infringement suit against copycat business.
- Obtained numerous summary judgments on behalf of county defendants for §1983 claims alleging violations of U.S. Constitution.
- Obtained Rule 12(b)(1) dismissal on behalf of county defendants in election fraud suit.
- Successfully resolved numerous product defect claims against manufacturers of automobiles and heavy machinery.
Arbitration
- Lead counsel on behalf of general contractor in AAA arbitration involving claims of breach of contract, construction defect, fraud, and breach of fiduciary duties.
- Lead counsel on behalf of auto dealer in JAMS arbitration involving claims for delay in issuance of title.
Administrative
- Obtained numerous dismissals of disciplinary proceedings on behalf of physicians, physician assistants, nurses, and dentists before the Texas Medical Board, Texas Board of Nursing, and Texas State Board of Dental Examiners.
- Obtained reduction in disciplinary sanction on behalf of physician before the Medical Board of California.
- Successfully negotiated reduced disciplinary sanction on behalf of investment advisor before the Texas State Securities Board.
