Overview

Whitney represents clients in complex commercial and civil litigation matters throughout the United States, with a particular focus on insurance coverage disputes, construction litigation, indemnity, and commercial controversies including partnership and real estate disputes. She brings more than 12 years of litigation experience to her practice at McGinnis Lochridge.

Whitney has extensive experience handling insurance disputes for corporate policyholders under property, professional liability, and commercial liability policies. She represents clients from pre-suit investigation through appeal, developing litigation strategy, analyzing legal issues across multiple jurisdictions, assessing potential exposure, and implementing litigation plans at every stage.

In addition to her litigation practice, Whitney regularly advises clients on insurance-related matters, including risk minimization strategies, indemnity agreement drafting, and obtaining optimum insurance coverage. Before joining McGinnis Lochridge, she represented both policyholders and nationwide insurers, giving her a well-rounded perspective on coverage disputes and litigation strategy.

Experience

Insurance Coverage & Policyholder Disputes

Whitney’s experience in this area includes:

  • Representing multinational electronics distributor in credit risk insurance policy dispute, managing all aspects of discovery, extensive witness preparation including corporate representative depositions, and serving as primary contact for opposing counsel and client.
  • Representing insured in coverage litigation challenging insurer’s wrongful interpretation and application of a “capacity of creditor” exclusion where underlying pleadings alleged violations of the Texas Securities Act, fraud, and misrepresentation.
  • Conducting coverage analyses on insurers’ duty to defend under “eight corners” analysis as well as indemnity analysis in construction disputes under Texas and Louisiana Anti-Indemnity Statutes.
  • Formerly representing multiple nationwide insurers in complex insurance litigation, professional liability defense (including lawyers, engineers, architects, and insurance agents), products liability defense, toxic torts, catastrophic injury and wrongful death, construction and surety matters, and first-party property claims.
