Overview

McGinnis Lochridge handles construction disputes on energy, industrial, residential, and public infrastructure projects in Texas. This work is handled by the same trial lawyers who try the firm’s commercial and energy cases, and by a Dallas partner who has spent thirty years defending architects, engineers, and worksite defendants.

Construction Defect Claims

We represent owners in large construction defect claims litigated in state and federal courts, and in arbitrations. These range in size from the high six figures up to tens of millions of dollars in damages. We can navigate through complex contractual agreements, and we have the expertise and bench of experts needed to successfully prosecute these claims in any forum.

Energy and Industrial Projects

We have represented owners and contractors, in separate matters, in disputes over cost overruns, extra work, and payment. Our experience includes an arbitration award in a refinery cost-overrun dispute and cost recovery claims on pipeline construction projects.

Residential and Multifamily Defect Claims

We defend contractors and subcontractors, often through their insurers, against defect claims on residential and multifamily developments, including claims by owners’ associations alleging defects throughout an entire project.

Architects and Engineers

We defend architects and engineers against claims of design error, including foundation cases and public works. One of our Dallas partners worked as a structural engineer at Bell Helicopter and Boeing before law school. He has spent thirty years defending architects, engineers, foundation engineers, and scaffolding and equipment companies in design-defect and workplace-injury cases, and he won a defense jury verdict for a civil engineering firm sued by a city over the design of two wastewater treatment plants.

Coverage, Indemnity, and Worksite Injury

These cases also bring coverage fights and worksite injury claims, and we handle those too. We litigate coverage, indemnity, and additional-insured issues under commercial general liability, professional liability, and commercial property policies, including questions governed by Texas and Louisiana anti-indemnity law. We defend contractors, scaffolding companies, and equipment providers in injury suits arising on construction and industrial sites.

Our lawyers who handle construction disputes practice in Austin, Houston and Dallas and appear in state and federal courts and in arbitration.
