Partner David Herrold, co-writing with J. Collin Spring of Burke Bogdanowicz PLLC, examines the ethical landscape facing in-house counsel who work across state lines in the April 2026 issue of the Dallas Bar Association's Headnotes. The article explores Texas' updated Rule 5.05, adopted in October 2024, which created a new in-house counsel exception allowing out-of-state attorneys to perform legal work in Texas for their employer and its "organizational affiliates" — without the need for traditional pro hac vice admission.

While the rule expands opportunities for businesses hiring in-house counsel, Herrold and Spring caution that meaningful ethical complexities remain, particularly around client identity, loyalty obligations, and representation of partially owned subsidiaries and joint ventures.
